Following our post on 18 November, key changes resulting from the Aged Care and Other Legislation Amendment (Royal Commission Response) Act 2022 commenced on 1 December 2022.
The restrictive practices changes in particular make significant (interim) changes to the consent arrangements for the use of restrictive practices. We will provide more detailed analysis of this change later.
The exposure draft materials we included in our previous table, were all finalised on 30 November and can be found on the updated table. Guidance which had been issued by the ACQSC in draft has also been finalised.
The subordinate legislation to implement the reforms in the Aged Care (Implementing Care Reform) Act 2022 has not been released yet but is expected soon given some of the changes start on 1 January 2023.
