Our team works with clients to secure their plans for the later years of their lives and formalise their wishes for when they pass away. We do this by preparing wills, testamentary and/or special disability trusts, binding death benefit nominations for superannuation, enduring powers of attorney, appointments of enduring guardianship, and statements under the family provision legislation explaining the reasons for distribution. We also review our clients' assets and circumstances, including of their beneficiaries, to advise on issues including asset protection and tax planning for their beneficiaries.
When a loved one passes away, there are a range of legal requirements that need to be met to manage their wishes and affairs. Our team assists by advising on the administration of deceased estates, including obtaining Grants of Probate and Letters of Administration.
When disputes arise over an estate, our team advises on claims for further provision from an estate, claims concerning the validity of wills, and equitable claims against estates. We can also act in other claims concerning wills and trusts such as for construction/rectification and judicial advice or declarations.
We act in the elder law space more broadly, including advising attorneys, acting in guardianship applications and acting when there are allegations of elder abuse (including to recover assets).
