Tax
Thomson Geer advises on the full range of taxation matters. Our tax team takes a strategic and practical approach to resolving issues and meeting our clients' commercial objectives.

Our clients include public and private corporations, small to medium enterprises, charities and not-for-profit organisations, high net worth individuals, private equity, venture capital and other managed funds, accountants and financial advisors, and superannuation funds.

The team also works closely with other areas of legal expertise in the firm, such as our corporate, banking and finance, property and construction, intellectual property and workplace relations teams, to enable us to provide a seamless, fully integrated service.

Tax advocacy

We assist our clients in their interactions with the Australian Taxation Office or state taxation bodies such as State Revenue Offices. Our team simplifies the process and minimises the stress of dealing with complex audits or protracted disputes with tax authorities to ensure clients achieve fair tax outcomes.

We deal with other regulatory bodies such as the Tax Practitioners Board in assisting tax agents with any enquiries or investigations, or with the police if allegations of white-collar or other criminal offences are made.

Business and investment structuring

Our team provides advice on how to structure businesses and investment opportunities so that clients achieve a desired taxation outcome that supports their business goals. We assist with advising on and establishing appropriate structures and ensuring they are suited to the client's needs to deliver the taxation and asset protection outcomes that clients want.

Transaction advisory

Our team works closely with our corporate group on public and private market restructures and mergers and acquisitions. Our team also advises on commercial disputes concerning tax liabilities.

Tax consulting

We advise on the full scope of Australian taxes, including income tax, capital gains tax, goods and services tax and state taxes and how they apply to a client's circumstances. The team guides clients through the complexities of tax law and offer sensible and commercially effective advice to satisfy each client's business and personal goals.

Trusts, Superannuation, Estates

The team has extensive experience advising on all taxation and legal issues around trusts, estates, superannuation and self-managed superannuation funds. We also advise trustees and beneficiaries on their rights and obligations under the tax law.

When disputes arise between beneficiaries of trusts or estates, or with regulatory authorities, we are able to help resolve them in a commercial and cost effective way. Our lawyers can quickly identify the issues in dispute, advise and negotiate on your behalf and achieve a satisfactory outcome.

International taxation

We advise on the tax implications of all inbound and outbound international transactions, including buying and selling Australian businesses and other assets by foreign entities, and residents acquiring foreign assets. We also advise on the personal tax requirements for foreign staff working in Australia or Australians working overseas.

Employment matters and ESOPs

Our team specialises in the structuring of remuneration arrangements for employees and contractors. Our team also advises on the establishment and operation of employee equity schemes (ESOPs) and other non-equity incentive schemes for resident and non-resident corporate clients ranging from companies in the start-up phase through to large publicly listed companies.
