August 12, 2022

The Aged Care and Other Legislation Amendment (Royal Commission Response) Bill 2022 (Bill) was passed by the Commonwealth Parliament on 2 August and received Royal Assent on 5 August 2022.

In line with the recommendations made by the Royal Commission into Aged Care Quality and Safety, the Aged Care and Other Legislation Amendment (Royal Commission Response) Act 2022 (Act) implements, among other matters, a new aged care subsidy funding model (commencing 1 October 2022), a star ratings system and a new Code of Conduct (both commencing 1 December 2022) for aged care providers. Details of the commencement date for each item can be found here.

For a full review of the changes proposed by the Bill which are now implemented with the passing of the Act, please see our previous blog on this topic here.

The Aged Care Amendment (Implementing Care Reform) Bill 2022, which is also discussed in our blog linked above, has been referred by the Senate to the Community Affairs Legislation Committee for inquiry and to report by 31 August 2022. Individuals and organisations are invited to make submissions by 12 August 2022. You can find the link to upload your submission here.
