Thomson Geer Aged Care Insight Report – an aged care legislation subscription service

Thomson Geer has developed and provided an aged care legislation subscription service for the past few years.

We have received positive feedback from our subscribers and will continue to provide the legislation subscription service to assist and support aged care providers to comply with legislative obligations.

On 20 March 2023, the latest Thomson Geer Aged Care Legislation Report (September 2022 to March 2023) was released, and is now available to aged care providers.

The latest legislation report includes:

  • a summary of all amendments to the aged care legislation (the Aged Care Act 1997 (Cth), the Aged Care Principles, the Aged Care Quality and Safety Commission Act 2018 (Cth) and the Aged Care Quality and Safety Commission Rules 2018 (Cth)), as relevant to residential and home care providers from September 2022 to March 2023;
  • commentary and recommendations for approved providers to implement operational changes to achieve compliance in response to changes;
  • commentary on our latest experience and observations in dealing with the regulators particularly in response to legislative change; and
  • commentary on what we see on the regulatory horizon.

Thomson Geer’s Aged Care Legislation Report is released twice a year and the second half of the report for the year 2023 is expected to be released in September 2023. The legislation report is available as a subscription service for an annual fixed fee.

Code of Conduct Policy and Procedure template

The new Code of Conduct commenced on 1 December 2022 and we recommend that approved providers have a Code of Conduct policy in place to ensure their aged care workers and governing persons understand and comply with the provisions of the Code of Conduct that apply to them.

Thomson Geer has prepared a Code of Conduct Policy and Procedure template which sets out:

  • a policy statement regarding the Code of Conduct;
  • the provisions of the Code of Conduct that apply to approved providers, aged care workers and governing persons;
  • the compliance obligations of approved providers, aged care workers and governing persons;
  • the consequences of non-compliance with the Code of Conduct; and
  • responsibilities regarding banning orders.
