Hayden is a technology sector, intellectual property (IP) and privacy law specialist.

With both law and IT qualifications, Hayden has a deep understanding of the technology and digital economy sector. Hayden can quickly grasp how both new and established technologies impact a client’s legal and commercial risks, and also how it can transform a business.

He is sought after to provide advice across complex IP and technology transactions. For privacy and cyber security, Hayden helps clients manage their data risks, comply with their privacy and security obligations, and to respond appropriately in the event of a cyber security incident. He also has extensive IP prosecution and strategy experience, and manages large IP portfolios for some of the world’s top brands including for trade marks, patents and copyright.

Hayden’s client base includes many well-known software vendors and organisations undertaking complex technology projects, and across a range of sub-sectors including fin-tech, defence-tech, med-tech and artificial intelligence. He also provides counsel to clients in regulated industries (such as health and aged care, education and financial services) on their technology, privacy and security risks.

He regularly speaks on legal issues across technology, IP and privacy law, including the RSA cyber security conference in San Francisco and AusCERT in Australia. Hayden’s enthusiasm for the technology industry is infectious and he is driven to achieve the best outcomes for his clients.

Experience

Athleisure retailer

Managing the global IP portfolio for one the largest athleisure retailers in the world, including providing strategic IP counsel on trade mark prosecution and oppositions throughout the world.

Encryption company

Acting for a major encryption company as its outsourced general counsel for over 10 years. This includes negotiating a global inbound OEM software and intellectual property licence for encryption key management and interoperability software to one of the world’s largest banks based on market capitalisation. The matter involved over 12 months negotiations with the New York head office of the bank.

Comparison website

Acting for major comparison website across multiple years on its digital products, privacy matters, ICT procurement and the commercialisation of IP. Of note, this included negotiating a contract with a critical service provider for the decoupling of the website's existing ICT systems and the procurement and implementation of new systems across its operating environment.

Automation technology

Acting for an automation technology company including providing strategic IP counsel on patent and trade mark issues, negotiating IP licensing agreements for the commercialisation of its IP in the defence and mining sector, and ultimately leading its acquisition by a large engineering company including IP due diligence.

Critical minerals

Acting for a critical minerals processing technology company on its IP strategy and commercialisation. This includes agreements with Queensland University of Technology for the assignment of its core intellectual property, and subsequent IP licensing agreements with other mining companies.

Transport technology

Acting for one of the world's leading providers of transportation technology and subsidiary of a global diversified software company. This includes advising on contracts with government departments for critical emergency services, and multi-year contracts for SaaS and implementation for transportation fleet management, payroll and rostering, both within Australia and internationally.
