Shane Sirett has extensive general dispute resolution experience, with a current focus on commercial litigation, employment advice and disputes and insurance.

Shane is a keen advocate of alternative dispute resolution and is a trained mediator. In addition to his more than 30 years of experience as a practising lawyer, Shane also spent four years in independent practice as a Barrister, and is an experienced advocate in State and Federal Courts and has appeared in a number of leading cases that have made new law in areas as diverse as adverse possession and the commercial tenancy legislation.

In the course of providing assistance in insurance and employment settings, Shane has appeared as counsel and provided advice in fatal and serious accident prosecutions under the State Occupational Safety and Health Act and in Coroner’s Inquests, as well as appearing in Fair Work Act litigation in Federal and State Industrial bodies and Courts.

Shane has presented to major accounting, mining industry and aged care providers on crisis management in relation to workplace allegations of harassment and bullying and has also provided legal advice to teams competing in national sporting code competitions.

Successfully resolving Company oppression proceedings against a minority director and obtaining control of the emerging cryptocurrency company.

Covid-19 emergency legislation

Representing landlord and a tenant in separate cases in the State Administrative Tribunal of Western Australia relating to the application of the Covid-19 emergency legislation and establishing new principles of law under that legislation in obtaining successful outcomes for both (Millennium Sports Pty Ltd and Vinciullo Holdings Pty Ltd [2021] WASAT 109; Jashan Technology Pty Ltd and Phoenix Properties International Pty Ltd [2022] WASAT 61).

Property legislation Western Australia

Acting as Counsel in a leading case on adverse possession which established the proper interpretation of provisions of property legislation in Western Australia and clarified the law (Ben-Pelech v Royle [2020] WASCA 168) in which Shane's clients succeeded at trial and on appeal.

Negotiating a settlements of a claim made by the Hell’s Angels Motorcycle Club alleging passing off and copyright infringement claim by our client, the manufacturer of Rocktape.
