Detangling the Fair Work Amendment - Closing Loopholes Bill

The Australian Labor Government's third wave of significant industrial relations reforms have been introduced to Federal Parliament.

Passing of the Fair Work Legislation Amendment (Closing Loopholes) Bill 2023 has been delayed until next year however after the Senate moved to delay its inquiry into the Bill.

If passed without amendments, the proposed changes will (among other things):

  • impose criminal sanctions including imprisonment and fines of around $8 million or more for wage theft;
  • give employee-like entitlements to gig economy workers;
  • change the test for determining if a worker is a casual employee, employee, or independent contractor;
  • require pay parity for some labour hire workers; and
  • introduce industrial manslaughter laws at the Federal level.
